1. General

These Terms apply to your use of Swipelijk on swipelijk.com and, where offered, in our supported mobile apps. By creating an account or purchasing a subscription, you agree to these Terms.

Governing law: Dutch law applies. Disputes are subject to Amsterdam courts, without prejudice to mandatory consumer rights in your country of residence (including the EU).

2. Accounts

You are responsible for keeping your login credentials secure and for activity under your account. You must provide information that is accurate enough for us to operate your account, billing, and support flows.

3. Acceptable use

Do not misuse the service, attempt unauthorized access, interfere with other users, automate abuse of the platform, or violate applicable laws.

4. Educational content and AI features

Swipelijk is an educational platform. We strive for high-quality content, feedback, and exam preparation, but we do not guarantee specific exam outcomes, language proficiency results, immigration outcomes, or official decisions by DUO or other authorities.

Some supported premium experiences may include AI-assisted feedback for writing or speaking exercises. This feedback is provided for learning support only and should not be treated as legal, immigration, employment, or official exam advice.

5. Subscription, billing, cancellation, and deletion

Payment processing: Web subscriptions are processed securely by Stripe. In the iOS app, App Store purchases are processed by Apple and subscription entitlement syncing may be handled by RevenueCat.

Pricing: Prices are in EUR and include VAT where applicable.

Auto-renewal: Subscriptions renew automatically unless canceled before renewal.

Cancellation: Web subscriptions can be canceled via settings or by contacting billing@swipelijk.com. App Store subscriptions must be managed through your Apple account subscription settings. Access continues until the end of the current billing period unless otherwise required by law.

Account deletion: Deleting your account removes your Swipelijk account and associated data from our systems, subject to legal retention obligations. Deleting your account does not itself cancel an active App Store subscription or other third-party billing arrangement; you must cancel those separately through the relevant provider.

Failed payments: For direct web subscriptions, you have 7 days to update payment details. After 7 days, access may be suspended. After 30 days, the subscription may be canceled.

Refund policy: Web refund requests are handled by us in line with these Terms and any mandatory consumer rights. App Store purchase refunds are handled by Apple under Apple's policies. Refunds may also be provided where required by law.

6. EU/EEA consumer right of withdrawal

If you are an EU/EEA consumer, you may have a 14-day withdrawal right for digital services. If you request immediate access to digital content during this period, you acknowledge that your withdrawal right may be reduced or lost once service delivery starts, to the extent allowed by law.

7. Account sharing policy

Accounts are for individual use only and may not be shared. We may monitor unusual access patterns, such as excessive concurrent sessions or abusive request patterns. Abuse may result in suspension, termination, or denied refund where permitted by law.

8. Intellectual property

All platform content, brand assets, and learning materials are protected by intellectual property laws. Personal learning use is permitted; redistribution is not.

9. Suspension and termination

We may suspend or terminate access where required for security, legal compliance, payment default, abuse, or Terms violations.

10. Service modifications and availability

We may modify, suspend, or discontinue features for technical, legal, or business reasons. We aim for high reliability but do not guarantee uninterrupted availability.

Some premium features, including AI-assisted feedback, may be subject to usage limits, maintenance windows, or provider availability.

11. Liability and disclaimers

Service is provided "as is." To the maximum extent permitted by law, our total liability is limited to the amount you paid in the previous 12 months, or EUR 100, whichever is greater.

We are not liable for indirect or consequential damages. Nothing limits liability that cannot be limited by law, including liability for fraud, gross negligence, or death/personal injury where applicable.

12. Indemnification

You agree to indemnify Swipelijk from claims arising from your Terms violations, misuse, or infringement of third-party rights, where allowed by law.

13. Third-party services

We rely on third-party providers:

  • Stripe (web payments)
  • Apple (App Store purchases in the iOS app)
  • RevenueCat (iOS subscription entitlement syncing)
  • OpenAI (premium AI feedback processing on supported experiences)
  • Sentry (error and crash monitoring)
  • Vercel (hosting)
  • Supabase (authentication and database services)
  • Resend (email delivery)

Third-party services have their own terms and policies.

14. Complaints and disputes

Please contact us first at support@swipelijk.com so we can try to resolve any issue quickly.

For billing questions, contact billing@swipelijk.com. For privacy or deletion requests, contact privacy@swipelijk.com.

If you are an EEA consumer and your complaint is not resolved, you may use the EU online dispute resolution platform where available: ec.europa.eu/consumers/odr.

15. General provisions

We may update these Terms. If any provision is unenforceable, remaining provisions stay in force. No-waiver, assignment, and entire-agreement principles apply under Dutch law.
